This website offers information about a class action lawsuit filed against New York City in March 2025.

The lawsuit relates to the City’s laws that require owners of at-risk properties to construct sidewalk sheds that encroach on neighboring properties. The lawsuit is about the rights of blameless New Yorkers who are required to have someone else’s shed on their own property.
Under the U.S. Constitution’s Takings Clause, a government that appropriates private property—or that causes someone else to do so—owes money to the owner or renter whose property is appropriated. Based on these legal requirements, this lawsuit seeks compensation from the City for the thousands of blameless New Yorkers who have been forced to endure having a neighbor’s shed touch their property or occupy any part of their property.
